CNN.com – NSA eavesdropping program ruled unconstitutional – Aug 17, 2006

Can you see the large smile on my face?

She declared that the program “violates the separation of powers doctrine, the Administrative Procedures Act, the First and Fourth amendments to the United States Constitution, the FISA and Title III.”

Her ruling went on to say that “the president of the United States … has undisputedly violated the Fourth in failing to procure judicial orders.”

Let’s hope the higher courts uphold this ruling.

    Is it really thinking with my butt to just want our President to obey the law?

    Look into this more, and you’ll find that the wiretaps the NSA have conducted could have been legally conducted through the FISA program. Not a single tap would’ve been blocked, as they have up to 72 hours with FISA to obtain the court order. The Bush Administration simply does not comply so they do not have to have judicial review. This isn’t about protecting the country, it’s about executive power unchecked.

    I can’t say this strongly enough, the only wiretaps the NSA could not get… and that’s relative, as they would have already started before actually getting the FISA order, would be ones which the FISA judges, historically lenient, deny.

    This is a blatant breaking of the law, and whether you are conservative or liberal you should be pissed as hell at what this administration is doing.
